Obama's eligibility issue goes to trial (2nd post)

The expedited trial has been set for Jan. 26, 2010, just 4 1/2 months from now!

I and many other concerned veterans and citizens attended the hearing today in Federal Court in Santa Ana in the lawsuit against Barack Obama to determine his eligibility to be President and Commander in Chief. About 150 people showed up, almost all in support of the lawsuit to demand that Obama release his birth certificate and other records that he has hidden from the American people.

Judge David Carter refused to hear Obama’s request for dismissal today, instead setting a hearing date for Oct. 5, since Obama’s attorneys had just filed the motion on Friday. He indicated there was almost no chance that this case would be dismissed. Obama is arguing this lawsuit was filed in the wrong court if you can believe that. I guess Obama would prefer a “kangaroo court” instead of a Federal court! Assuming Judge Carter denies Obama’s motion for dismissal, he will likely then order expedited discovery which will force Obama to release his birth certificate in a timely manner (if he has one).

The judge, who is a former U.S. Marine, repeated several times that this is a very serious case which must be resolved quickly so that the troops know that their Commander in Chief is eligible to hold that position and issue lawful orders to our military in this time of war. He basically said Obama must prove his eligibility to the court! He said Americans deserve to know the truth about their President!

The two U.S. Attorneys representing Barack Obama tried everything they could to sway the judge that this case was frivolous, but Carter would have none of it and cut them off several times. Obama’s attorneys left the courtroom after about the 90 minute hearing looking defeated and nervous.

Great day in America for the U.S. Constitution!!! The truth about Barack Obama’s eligibility will be known fairly soon - Judge Carter practically guaranteed it!

The left is pretty concerned with inaccurate details...

...while they ignore glaring ones. Obama's Certificate of Live Birth had many glaring errors on it, namely the use of the term "African," a term not used in 1961, but Negro was. Or the lack of folds on the paper that had been claimed to be mailed. Or the date "2007" bleeding through and visible. Or the fact that Hawaiian officials said they examined the real birth certificate in 2008, no wait, they destroyed all paper copies in 2001, no wait, we didn't mean that, the paper copies are still here after all. Now Hawaii even refuses to verify the COLB released to the public by Obama and the other one obtained by factcheck.org. Wat a mess.

Yet the left claims the document Attorney Orly Taitz uncovered is a fake because at the bottom it says "Republic Of Kenya" dated 2/1964 and the Republic was not declared until 12/1964. Would that they were so attentive to detail on the COLB!

First, Kenya declared independence in 12/1963, not 1964. Second, the area that Obama was likely to have been born was using the term Republic even prior to that, in a long-standing land dispute with Zanzibar that still runs today.

The left's squashing continues to no avail. You ever put your thumb on mercury? It squirts out in another direction. That is what happens to truth, it keeps popping up from different directions when you least expect it.

Authentic looking Kenyan birth certificate surfaces

Is this the smoking gun in the birther movement? I remember Obama's grandmother saying he was born in Kenya. Also the Kenyan Ambassador said the same. Many have suspected all along he was. And when Obama released the ridiculous Certificate of Live Birth (COLB) and it had no fold-creases, no mention of attending physician and no seal, it just got surreal that we should accept his eligibility on such flimsy evidence. The COLB was a document anyone could obtain whether you're born in Hawaii or not.

Then today, this surfaces, thanks to Orly Taitz:

Forensic tests are being down now to determine authenticity. Also she has lodged a "Motion for rogatory discovery to authenticate Kenyan Birth Certificate of Barack Hussein Obama and in addition, is looking for help with legalities in Britain. If you go to her site it says it is a malware attack site but that is not true.

The document posted online looks more real than his COLB, it has pertinent information, a raised seal, doctor signature, and creases where it has been folded. All items the COLB lacks.

This should get really, really interesting! I personally believe he is not eligible to serve according to the rules set out in the Constitution, but the Constitutional crisis resulting from this coming to a head will be massive. I fear for our country...

Birth certificate eligibility lies contradicting themselves now (UPDATED)

State of Hawaii official Statement October 2008-

Obama's Birth Certificate Verified By State
"Therefore, I as Director of Health for the State of Hawai‘i, along with the Registrar of Vital Statistics who has statutory authority to oversee and maintain these type of vital records, have personally seen and verified that the Hawai‘i State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures," Fukino said.

CNN's Lou Dobbs is starting to wonder where the birth certificate is, and said so numerous times this week. This query prompted a vicious reaction from J. Richard Cohen, chief of the left-leaning Southern Poverty Law Center who called for Dobbs's firing. In the ongoing "Shut up Lou Dobbs" campaign under obvious pressure, per CNN President John Klein in his response to the Letter:

"It seems this story is dead- because anyone who still is not convinced doesn't really have a legitimate beef." Klein asked CNN researchers to dig into the question of why Obama couldn't produce the original birth certificate. The researchers contacted the Hawaii Health Dept. and confirmed that paper documents were discarded in 2001 when the department went paperless. That reportedly includes Pres. Obama's original birth certificate.

So....how can Fukito have examined a document in 2008 that was discarded in 2001?

UPDATE: "Vital records (birth, death, marriage, and divorce certificates) for events that occurred in Hawaii are received and preserved by the Office of Health Status Monitoring, a unit of the Department of Health. Certified copies of these records may be issued to authorized individuals and used for such diverse purposes as school entry, passports, Social Security participation, driver’s licenses, employment, sports participation, survivor’s benefits, proof of property rights, and other needs."

1. Someone should tell the webmaster over in Hawaii to change that language about preserving the certificates. All the paper has been discarded when they went digital in 2001.

2. How can the Department issue a certified copy of a certificate that was discarded in 2001?

Meanwhile people are starting to clue in that the first Executive Order Obama signed was to suppress release of his birth certificate. Probably a smart thing since Obama can't remember which hospital he was born in. Hmmm, was it Kapiolani? Or Queen's Medical? No matter, career soldiers are balking at deployment because they are charging he is usurper. Where will it end? The illegitimacy of his presidency seems to be gathering steam even as his poll numbers plummet.

"The California secretary of state should refuse to allow the state's 55 Electoral College votes to be cast in the 2008 presidential election

until President-elect Barack Obama verifies his eligibility to hold the office, alleges a California court petition filed on behalf of former presidential candidate Alan Keyes and others."

"The legal action today is just the latest is a series of challenges, some of which have gone as high as the U.S. Supreme Court, over the issue of Obama's status as a "natural-born citizen," a requirement set by the U.S. Constitution."

Where' there's smoke, there's fire. This is not the first court case to allege Obama needs to assuage suspicions that he is not a natural-born citizen and thus not constitutionally qualified to be President. PA, CA, WA, CT and other states have also filed suits. Wonder where this will all lead.

Obama is not Constitutionally qualified to be President

Philadelphia Lawyer Philip Berg has filed a lawsuit to stop Barack Obama from proceeding in his bid for the presidency on the basis that he is not qualified as a candidate, under the rules of the constitution. The evidence, physical and historical, indicate that Obama was not born in Hawaii and is not a US citizen under the rules established by the Constitution that Presidents must be natural born citizens of the United States.

In attempting to deflect the issue, Obama released a birth certificate on his website but it was immediately detected as an obvious forgery, having none of the usual seals, folds, and information required for HI certificates of live birth from that era. This was confirmed by separate graphic forensic investigators.

Additionally, evidence shows that Obama was born in Kenya. Obama's Fight The Smears website, designed to set the record straight about Barack Hussein Obama, has actually made it worse by stating the Democrat presidential candidate was a Kenyan citizen until 1982. He was also at one time an Indonesian citizen as well. School papers list Obama as a Muslim with Indonesian citizenship. Obama is not eligible to be President.

Berg's lawsuit is progressing, and September 24 was the deadline for Barack Obama to file a response to the lawsuit, initiated by Democrat lawyer Philip Berg, which charges Obama with not fulfilling the constitutional requirements to be elected president, since he is not a natural born citizen of the United States. Barack Obama did not actually respond: he introduced a motion for dismissal, a typical delaying maneuver that makes the defendant look even more suspect.

If Obama is a citizen, why doesn't he just produce the real certificate? Why deflect in a suspicious motion that doesn't actually answer the question?

The answer: because he is ineligible.

Obama Sued in Philadelphia Federal Court on Grounds he is Constitutionally Ineligible for the Presidency

A prominent Philadelphia attorney and Hillary Clinton supporter filed suit this afternoon in the U.S. District Court for the Eastern District of Pennsylvania against Illinois Sen. Barack Obama, the Democratic National Committee and the Federal Election Commission. The action seeks an injunction preventing the senator from continuing his candidacy and a court order enjoining the DNC from nominating him next week, all on grounds that Sen. Obama is constitutionally ineligible to run for and hold the office of President of the United States.

Phillip Berg, the filing attorney, is a former gubernatorial and senatorial candidate, former chair of the Democratic Party in Montgomery (PA) County, former member of the Democratic State Committee, and former Deputy Attorney General of Pennsylvania. According to Berg, he filed the suit--just days before the DNC is to hold its nominating convention in Denver--for the health of the Democratic Party.

"I filed this action at this time," Berg stated, "to avoid the obvious problems that will occur when the Republican Party raises these issues after Obama is nominated.".

Berg cited a number of unanswered questions regarding the Illinois senator's background, and in today's lawsuit maintained that Sen. Obama is not a natural born U.S. citizen or that, if he ever was, he lost his citizenship when he was adopted in Indonesia. Berg also cites what he calls "dual loyalties" due to his citizenship and ties with Kenya and Indonesia.

Even if Sen. Obama can prove his U.S. citizenship, Berg stated, citing the senator's use of a birth certificate from the state of Hawaii verified as a forgery by three independent document forensic experts, the issue of "multi-citizenship with responsibilities owed to and allegiance to other countries" remains on the table.

In the lawsuit, Berg states that Sen. Obama was born in Kenya, and not in Hawaii as the senator maintains. Before giving birth, according to the lawsuit, Obama's mother traveled to Kenya with his father but was prevented from flying back to Hawaii because of the late stage of her pregnancy, "apparently a normal restriction to avoid births during a flight." As Sen. Obama's own paternal grandmother, half-brother and half-sister have also claimed, Berg maintains that Stanley Ann Dunham--Obama's mother--gave birth to little Barack in Kenya and subsequently flew to Hawaii to register the birth.

Berg cites inconsistent accounts of Sen. Obama's birth, including reports that he was born at two separate hospitals--Kapiolani Hospital and Queens Hospital--in Honolulu, as well a profound lack of birthing records for Stanley Ann Dunham, though simple "registry of birth" records for Barack Obama are available in a Hawaiian public records office.

Should Sen. Obama truly have been born in Kenya, Berg writes, the laws on the books at the time of his birth hold that U.S. citizenship may only pass to a child born overseas to a U.S. citizen parent and non-citizen parent if the former was at least 19 years of age. Sen. Obama's mother was only 18 at the time. Therefore, because U.S. citizenship could not legally be passed on to him, Obama could not be registered as a "natural born" citizen and would therefore be ineligible to seek the presidency pursuant to Article II, Section 1 of the United States Constitution.

Moreover, even if Sen. Obama could have somehow been deemed "natural born," that citizenship was lost in or around 1967 when he and his mother took up residency in Indonesia, where Stanley Ann Dunham married Lolo Soetoro, an Indonesian citizen. Berg also states that he possesses copies of Sen. Obama's registration to Fransiskus Assisi School In Jakarta, Indonesia which clearly show that he was registered under the name "Barry Soetoro" and his citizenship listed as Indonesian.

The Hawaiian birth certificate, Berg says, is a forgery. In the suit, the attorney states that the birth certificate on record is a forgery, has been identified as such by three independent document forensic experts, and actually belonged to Maya Kasandra Soetoro, Sen. Obama's half-sister.

"Voters donated money, goods and services to elect a nominee and were defrauded by Sen. Obama's lies and obfuscations," Berg stated. "If the DNC officers ... had performed one ounce of due diligence we would not find ourselves in this emergency predicament, one week away from making a person the nominee who has lost their citizenship as a child and failed to even perform the basic steps of regaining citizenship as prescribed by constitutional laws."

"It is unfair to the country," he continued, "for candidates of either party to become the nominee when there is any question of the ability to serve if elected."

Berg said that he's acting on his own, not as an agent for the Clinton campaign. Republicans were prepared to file a similar lawsuit after the Democratic convention, he said.
